. UrCom was selected to write an Expert Report on behalf of JAZAN in its battle against TECORE and its CEO Mr. Jay (Jihad) Salkini.

UrCom, an independent consulting company was selected to examine TECORE equipment that was used but failed to function with Moutiny project in Iraq.    Mr. Ammar AlFatlawi, spokesman for UrCom stated that because of the high profile of this case we will be using Chief Technical Officers from the major six telecom companies in Iraq to help write this report.   In addition, we will hire consultants from major telecom companies in the Middle East and Africa to review such report to ensure its accuracy. 

 Moutiny on one side and TECORE and its CEO Mr. Jay (Jihad) Salkini on another side have been battling each other in US and Iraqi courts for almost three years.   Moutiny accused TECORE and its CEO Mr. Jay Jihad Salkini of fraud, misrepresentation, selling CDMA equipment before obtaining proper QUALCOMM license, unable to provide technical support, unable to commission its equipment, charging restocking fees of 100% on equipment never shipped, etc. while TECORE blames the US army and TV stations in their inability to commission their equipment.  This is what TECORE independent Expert witness Dr. Faris Al Salihi stated during a proceeding at Howard Circuit County court in Maryland.   Dr. Al Salihi was asked if in the same court if it is possible the interference from the US army and TV stations pick only Moutiny network and caused such problems and he replied no, Asia Cell network also suffered from dead air issues, one way audio, repeated service interruption, drop calls, noise on the lines, echo, etc. However, such allegations by Dr. Faris Al Salihi were not substantiated by any data and that Asia Cell is known to all Iraqis to have one of the best and reliable Mobile services in Iraq.   Huawei Technologies provided equipment for Asia Cell.

Dr. Faris Al Salihi agreed to serve as an independent Expert witness for defendants TECORE and Mr. Jay Jihad Salkini after he was offered and accepted a salesman position with TECORE.  Dr. Faris Al Salihi indicated that he did not see any issue to accept a salesman position with TECORE and then agree to be TECORE’s independent expert witness.  He also stated that he never had any prior sales experience and that he never closed any sales deal for TECORE while working as a salesman for them.  He is currently working for Shali For Communications (SFC), a company controlled and financed by Mr. Jay Jihad Salkini in Kirkuk, Iraq.  For complete information on Dr. Faris AlSalihi’s deposition and his testimony at Howard Country Circuit court please see Howard County Circuit court at http://www.courts.state.md.us/circuit/ or Iraq Telecom Association website at www.iraqita.net.  Information is to be uploaded on Iraqi Telecom Association soon.

TECORE was also battling MP Telecommunications for breach of contract at a Florida court http://dockets.justia.com/docket/court-flmdce/case_no-8:2008cv00313/case_id-210396/, battling  Moutiny at Howard Circuit County Court in Maryland , http://www.courts.state.md.us/circuit/, battling Kalimat Telecom, a national CDMA operator in Iraq, in Kuwait where TECORE was asked to pay Kalimat for a breach of a contract case, Battling  Moutiny in Iraq at the Karada court, Baghdad. 

JAZAN is one of three former Moutiny Mater dealers that are seeking compensation for their damages because of the failure of Moutiny’s network to provide wireless services. TECORE and its CEO Jay Salkini have been defending themselves for their inability to provide “Commercially Suitable Equipment” based on their agreement with Moutiny.

TECORE also known as TECORE Wireless Systems, TWS, TECORE Networks, is operating out of Colombia, MD and an offshore office in Dubai.

Dr. Faris Al Salihi, an Iraqi born Kurd, has been employed by Shali For Communications (SFC) for less than a year.  Prior to working for SFC, he was unemployed for a few months when he applied then to work for TECORE.  He also worked for Asia Cell, a GSM operator, in Iraq for one year.  Before joining Asia Cell he also worked for about a year at the Iraqi telecommunications agency (NCMC).  Prior to working for the NCMC, he held other positions with other entities for a year or two each, including his own consulting company WATCO.

. Howard County Court in Maryland dismisses Fraud Allegations filed by Aramtel Limited

Aramtel Limited of UAE and TECORE Wireless Systems of UAE (TECORE) entered into an agreement with Moutiny of UAE to launch a Wireless Local Loop project in Iraq in 2006. Mr. Jay (Jihad) Salkini is director of Aramtel and president and CEO of TECORE. TECORE Wireless Systems of Colombia, MD also known as TECORE Networks provided the equipment and technical support for the Moutiny project.   

A Howard County Court judge dismissed all fraud allegations filed by Aramtel Limited against Moutiny and its CEO Dr. Faisal Fadul on May 6th 2009.   Moutiny and its CEO Dr. Faisal Fadul have filed a fraud lawsuit against TECORE and its CEO Mr. Jay (Jihad) Salkini in the amount of $50,000,000. The fraud lawsuit accuses Mr. Jay (Jihad) Salkini, oh his inability to provide “commercially suitable equipment”, providing defective TECORE CDMA Equipment, TECORE’s failure to provide technical support and making intentionally false representation about TECORE’s equipment specifications. The trial is set to begin in September of 2009.

. TECORE & its CEO Jay Salkini are Implicated in a new Fraudulent Lawsuit in Iraq.

TECORE, a WLL Integrator, operating out of Colombia, MD and its CEO Jay Salkini are being implicated in new fraudulent activities in a court in Iraq. These allegations were raised by several master dealers of TECORE’s former customer Moutiny, Ltd in Iraq. The new accusations, which are supported by TECORE press releases, allege that TECORE fraudulently sold CDMA equipment to Moutiny Ltd. on April 15th 2006 (please refer to TECORE’s press release from 9/11/06 which alleged a successful deployment of a CDMA network in Iraq (1) ), while TECORE did not obtain a permission from QUALCOM to build CDMA equipment until November 21st 2006 (please refer to TECORE’s press release from 11/21/06 (2 ) ).  TECORE also claims to have deployed the network in September 2006 (please refer to TECORE’s press release from 9/11/06 (3) ). The lawsuit filed against TECORE and its CEO Mr. Jay Salkini in Iraq alleges that TECORE was never capable of commissioning its CDMA network after a year and a half long installation period, therefore, causing huge financial damages to Moutiny and its master dealers who invested in sales and marketing to promote the TECORE network.

. Iraqi GSM and CDMA operators battle for the national and international rates in Iraq

The competition is fierce in Iraq among GSM and CDMA operators in Iraq.  After the conflict of 2003 in Iraq, a call to the US and or Europe cost as high as $5.00 per minute using satellite phone mainly from Thuraia, a UAE based company.  The quality then was in question and callers have to make calls in the open in the streets or the top of buildings.  Today, Iraqis can enjoy aggressive rates to the US and Europe for as low as 12 cents per minute from GSM operators and 9 cents per minute with CDMA operators.  National calls are dropping as well.  In 2003, the only operational national telephone network in Iraq was the Iraqi Telecommunications and Post Company with a penetration ration of 1.5%.  Today Zain alone has about 10,000,000 subscribers followed by Asia Cell with close to 3,000,000 subscribers.  National calls were impossible to go through due to obsolete equipment and continued fiber optic cuts.  Land line phones sold until 2004 each over $1,000 per line and they were hard to find.  Today Iraqis enjoy national calls for as little 3 cents per minute with GSM operators and 1 cent per minute with almost all CDMA operators.  Phones can be purchased and activated within a few minutes for free.   The three GSM and three CDMA operators fight for the Iraqi people business with never heard of promotions, and superb customer care services.

. Three Former Moutiny Master Dealers filed a lawsuit for $15,000,000 against Moutiny’s Equipment supplier TECORE and its CEO, Mr. Jay (Jihad) Salkini.

Three former Moutiny Master Dealers led by Mr. Falah Al Yasisry filed a lawsuit in the amount of $15,000,000 against Moutiny’s equipment supplier TECORE Wireless Systems and its CEO Mr. Jay (Jihad) Salkini personally.  The lawsuit was filed at the Provincial Court of Najaf, Iraq on February 15th 2009.  The lawsuit, according to Mr. Al Yasiry, accuses TECORE and Its CEO of fraud, unable to commission commercially suitable wireless equipment, selling equipment without proper testing, and making false promises about its CDMA equipment capabilities.  Mr. Al Yasisry stated that all evidence from the Iraqi Telecommunications and Post Company engineers, former Moutiny engineers and a well documented expert report submitted to a US court in Colombia, MD, where Moutiny and TECORE Wireless Systems lawsuits have been filed, point fingers at a complete failure of TECORE equipment.

Itisalona replaced its CEO in Iraq

Itisalona, one of three major WLL operators, has replaced its CEO in Iraq in December 2008.  Mr. Suleiman Mando, a Jordanian citizen, was replaced by Dr. Sermad Al Delami.  Dr. AlDilami is an Iraqi individual with strong ties to Iraq.

Iraqi Telecom Industry takes active part in Recent Elections

 Over the last local elections Iraqi citizens were bombarded with SMS messages on their Mobile and Fixed Wireless Local Loop phones to vote for political and individual candidates.  One of the Iraqi main political parties accused the Iraqi main two operators Zain and Asia Cell for playing a biased role in such elections; however both operators vehemently denied such accusations.  Some of the SMS messages sent were considered offensive by some Iraqis.

. The Iraqi National Communications and Media Commission is still without a president

 The Iraqi National Communications and Media Commission (NCMC) continue to operate without a president for almost a year.  After the resignation of Dr. Sayamand Othman, the NCMC is now paralyzed to make any executive decisions and rely heavily on all of its decisions on the Telecom Committee at the Iraqi Parliament.

Kalimat is to launch its network in Baghdad by quarter one of this year.  The network is cover mainly the Kargh district of Baghdad and coverage will be extended to Rasafa by the second Quarter of 2009.

Zain CEO announced recently that Zain will acquire as many as 22 telecom companies in the Middle East and Africa allowing customers to make international calls as easy as making local calls.

. Zain continues to struggle to integrate Atheer and Iraqna GSM networks

 Iraqna is a network that was operated by ORSCOM, an Egyptian based company, and Atheer a Kuwaiti owned company.  Since Atheer took over Iraqna network and became Zain this year, some subscribers continue to struggle with quality.  October 18 2008.

. TECORE is to be placed on Iraq's Black List of companies for its failure to provide commercially suitable equipment.

Several former Master Distributers of two Iraqi operators, which previously purchased wireless telecom equipment from TECORE Wireless Systems (TECORE), met recently at Babel Hotel, Baghdad, Iraq to discuss the filling of a joint lawsuit against TECORE and its president and CEO Mr. Jay (Jihad) Salkini. The meeting was focused on placing TECORE on Iraq's blacklist of companies so that no other Iraqi operator will be duped to purchase TECORE equipment which failed to operate commercially in Iraq. TECORE, Inc. of Colombia, MD, listed TECORE Wireless Systems on its website as its Dubai Branch office. Mr. Jay (Jihad) Salkini is the president and CEO of both companies TECORE, Inc. of Colombia, MD and TECORE Wireless Systems, Ltd of Dubai. Mr. Jay (Jihad) Salkini is accused of fraud & making false representation about TECORE equipment among other things in another lawsuit filed against him personally and TECORE at the Circuit Court of Howard, MD in May 2008.
TECORE sold wireless equipment to two Iraqi operators who ended up not using them for their failure to operate in a commercial manner.
